Terms of Service

1. Acceptance of Terms

By creating an account or using Pounce Alerts ("Pounce", "we", "us", "our"), operated by Pounce Alerts (ABN 69 474 045 566), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

Pounce monitors publicly accessible Facebook Marketplace listings on your behalf, based on search terms, cities, and price ranges that you configure, and notifies you (via email and/or Telegram, depending on your plan) when new matching listings appear.

As stated above, Pounce is an independent third-party tool and is not affiliated with Facebook or Meta in any way. Use of Facebook Marketplace itself remains subject to Meta's own terms of service.

3. Accounts & Eligibility

You must provide a valid email address to create an account and are responsible for maintaining the confidentiality of your password and any two-factor authentication credentials. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Pounce.

4. Subscriptions, Pricing & Billing

Pounce offers Free, Starter, and Pro subscription tiers as described on our pricing page. Paid subscriptions are billed in advance on a recurring basis through our payment processor, Stripe, and renew automatically until cancelled.

You can cancel or manage your subscription at any time from your Account page via the Stripe billing portal. Cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

5. Acceptable Use

You agree not to:

• Use Pounce for any unlawful purpose or to violate the rights of others;
• Attempt to disrupt, overload, or reverse-engineer the service;
• Use the service to scrape or resell data at scale to third parties;
• Share your account credentials with others.

6. Third-Party Services & Data Sources

Pounce relies on the following third-party services to operate:

• Facebook Marketplace — the source of listing data we monitor on your behalf. We do not control the availability, accuracy, or completeness of this data.
• Stripe — for processing subscription payments.
• Our email provider — for delivering transactional emails and alert digests via SMTP.
• Telegram — optionally, for delivering instant alerts to Pro subscribers who connect a Telegram chat.

Because listing data originates from a third party we do not control, we cannot guarantee the accuracy, completeness, availability, or timeliness of any listing or alert.

7. Disclaimers

Pounce is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the service.

8. Limitation of Liability

To the maximum extent permitted by law, Pounce Alerts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of, or inability to use, Pounce — including any missed, delayed, or inaccurate alerts.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using Pounce and delete your account at any time by contacting us at admin@pouncealerts.com.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of Pounce after changes take effect constitutes acceptance of the revised Terms. We will update the "Last updated" date above when changes are made.
